Is Kalshi Legal?

Yes. Kalshi is a CFTC-designated exchange and has been since November 2020, which makes it legal under federal law across the US. Its sports contracts are a different story: they're currently off in Nevada, Washington and Michigan, and several other states are fighting Kalshi in court.

Federal status

The CFTC designated KalshiEX LLC as a contract market on November 3, 2020, and since August 2024 its trades have cleared through its own registered clearinghouse, Kalshi Klear. In 2024 Kalshi won the right to list election contracts in federal court in Washington, D.C., after the CFTC tried to stop it, and the CFTC later dropped its appeal.

The court cases

Kalshi has won and lost. The 3rd Circuit sided with it against New Jersey in April 2026, while the 9th Circuit (Nevada) and 6th Circuit (Ohio and Tennessee) sided with the states. New Jersey has asked the Supreme Court to take the case, and a Maryland appeal is still waiting for a decision. In Massachusetts, an order blocking Kalshi’s sports contracts was put on hold while the state’s highest court decides. Age

Kalshi’s help centre sets the minimum age at 18, but its member agreement asks for the age of majority in your state, which is higher than 18 in a few states.
